Hasken Kanawa’ In Trouble- EFCC Arraigns Bashir I Bashir as he launches counter suit

Bashir Ishaq Bashir  alongside his companies, Leda Greenpower Consortium, Leda Greenpower Nigeria Limited and Leda Consortium Limited have been charged before Justice S.E. Aladetoyinbo of the Federal Capital Territory, FCT High Court, Maitama, in Abuja.

Bashir is facing a three-count charge of obtaining by false pretence and cheating to the tune of $1 million.
According to the EFCC, Bashir was alleged to have collected the money as part payment of a $3 million agreement from Althani Investments Company Limited for the purpose of forming a consortium to bid for shares at the Kaduna Electricity Distribution Company. The bidding failed and several attempts made by the company for a refund of the money proved abortive.
 He pleaded “not guilty” to the charges when they were read to him. Prosecution counsel, Rimamsomte Ezekiel, thereafter asked for a trial date.
Counsel for the defendant, A.B. Anachebe, SAN, moved the motion for his bail application. 
Ezekiel opposed the application, arguing that “the defendant if granted bail will interfere with prosecution witnesses”. He further argued that the application was not proper in the sense that the defence only mentioned the name of the first defendant without reference to the second, third and fourth defendants.
Justice Aladetoyinbo, while adjourning to April 10, 2017 for hearing granted him bail in the sum of N2 million and one surety in like some. The surety must be resident in Abuja and must have a landed property. 
However, Mr Bashir has already launched a counter suit  challenging his detention
Joined in the suit are Mr Musbahu’s company, Althain Energy Ltd and Federal Ministry of Justice.According to Bashir’s associates, Mr Musbahu allegedly purchased 20 per cent of shares of LEDA consortium at $3million in March 2013, under a defined agreement to pay a non-refundable sum of $1million to go into the bid.

According to the agreement, Mr Musbahu would pay the balance of $2m if the company wins the bid or be compensated with 5% shares in one of the consortium’s sister companies.

When LEDA Greenpower Ltd lost the bid, it dragged the Bureau for Public Enterprise, BPE, to an Abuja High Court for violation of privatisation and bidding guidelines. The case is still subsisting..

Three years after losing the bid, Mr Musbahu allegedly involved a top officer of the EFCC to detain and “intimidate” Mr Bashir to pay the $1million he paid to the company.

Bashir’s lawyers have now filed a case at an Abuja High Court, seeking payment of N250million being exemplary damages for false accusations, illegal detention and violation of his fundamental right.

Mr Bashir is also seeking a declaration that Mr Musbahu was not entitled to use his connections with the EFCC operatives and settle a case that is purely civil and business dispute arising from their joint venture to bid for the Kaduna DISCO.

He is also seeking an order directing the EFCC to unfreeze the bank accounts of his companies, LEDA Greenpower Ltd, COEC Construction Ltd, FINETECH Nig. Ltd, AMALTRAD Nig. Ltd, Horizon Hotels Ltd, Horizon Nig. Ltd and Radiant Future Ltd.
